Music Downloader Fined $80,000 Per Song



Jammie Thomas-Rasset, the lady in the high profile illegal music downloading story that was in the news a while back, just had her second federal trial and has been charged with infringing 24 copyrights (for the 24 songs she downloaded). She's to pay $80,000 per song, a total of $1.92 million. Shiiiiiiiiiit.

As for Thomas-Rasset, she appeared shaken by the verdict but didn't blame the jury. "They did their job," she said, "I'm not going to hold it against them." She added, though, that the recording industry would never collect the money. "Good luck trying to get it from me... it's like squeezing blood from a turnip."


The recording industry lawyers, though clearly pleased, had no desire to showboat this one. The massive damage award, which increased from $9,250 per song in the first trial to $80,000, might sounds like a "win," but will probably stoke grassroots anger against the industry's campaign... if the music business tries to collect. There are hints that it might not.

I have never seen any golden horses or have had the luxury of 'riding' one, maybe you should direct me in the right way to this so I may ride gold horses till the sun sets. I really dont think they expect to get 80,000 per song, this woman would be long dead before she makes 1.92 million in her life.

As far as I see it, these people produce the music and retail it to the world and everyone rips it and doesn't pay and it's been happening before mp3's so wouldnt you be pissed off if it were your business and people were constantly taking from you? And music IS a business...who's gonna pay for a guitar when they can't get any backing from record companies? (As a matter of fact most record companies pay for studio time, advertising, label design and distribution, copyrighting peoples work so that others can't claim it as thier own...ect ect.) Record companies aren't big evil cash mongers hanging over thier artists demanding they earn them money, they actually support the artist in a HOPE that they can get a percentage of the artists takings.

Ultimately my point is $80k per song is gross misjustice. I can be testamount to ripping TV shows and watching them. Once I decide if i like it i will buy the box sets etc. e.g. try before you buy. (deleting the content that i don\'t like)

For example, you hear a great song on the radio and you want to buy their album thinking that their other songs are going to be ok, not chart toppers but ok and it turns out that the rest are complete shit and you feel like you wasted $30 bucks.

Whichever way you look at it there are arguments for both sides. My reasoning behind this is the gross level of compensation they sought after from a person who clearly cannot pay for it, they are screwing her over for life and will drain whatever money they can from her. Yes she did the wrong thing, but people that go to jail for rape get out eventually.

recording artists, songwriters get at best 10% or so of the earnings that their music creates, and in the above case (Even if she could pay up) i doubt the artists of the 24 named songs are going to receive the approx amount of $7900 of that 10% for each song.

apparently the original type of fine or whatever was like $795 per song, which went up to $9, 250 per song, and now up to $80 000. i find it very hard how they can justify such a leap unless she was profiting from this on a big enough scale to warrant such steep numbers.

in the main article, the jury allowed the fine because they were pissed that she lied and denied she dowloaded the music when her MAC address or her PC AND router was recorded as the culprit.

She won't because she got screwed over because a recording artist missed out on 50 cents and the RIAA wanted to make an example of her.

Why don't the treat her like a thief, technically that's what she did. she stole about $30 worth of music (Retail price). people that rob banks dont get 1.9m in fines, they get a few years in jail. so should she. at least she learns her lesson, isn't screwed over for life and becomes a testament.

well obviously only you will use it as a last solution if the cops come with a warrant for the tower, that's how it was in the show, the suspect hung it on wall at the door frame and covered it with a poster or something and it got erased once the cops removed it.
